{"id":14153,"date":"2022-06-02T19:58:34","date_gmt":"2022-06-03T00:58:34","guid":{"rendered":"https:\/\/www.bbmnoticias.com\/labravaradiofm\/?p=14153"},"modified":"2022-06-02T19:58:35","modified_gmt":"2022-06-03T00:58:35","slug":"scjn-valida-decreto-de-amlo-que-reduce-tiempos-oficiales-en-radio-y-tv","status":"publish","type":"post","link":"https:\/\/www.bbmnoticias.com\/labravaradiofm\/2022\/06\/02\/scjn-valida-decreto-de-amlo-que-reduce-tiempos-oficiales-en-radio-y-tv\/","title":{"rendered":"SCJN valida decreto de AMLO que reduce tiempos oficiales en radio y TV"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div>\n<p>El pleno Suprema Corte de Justicia de la Naci\u00f3n (<strong>SCJN<\/strong>) valid\u00f3 el <strong>decreto de AMLO<\/strong>que reduce los tiempos oficiales en radio y televisi\u00f3n (<strong>TV<\/strong>).<\/p>\n\n\n\n<p>Dicho de otra forma, el <strong>decreto de AMLO <\/strong>reduce los tiempos con los que los concesionarios privados de radio y televisi\u00f3n cubren en especie los llamados \u201ctiempos fiscales\u201d.<\/p>\n\n\n\n<p>El 7 de mayo del 2020, el INE present\u00f3 una controversia ante la SCJN en la que se argumenta la medida afect\u00f3 su facultad exclusiva de administrar tiempos en radio y televisi\u00f3n abierta, adem\u00e1s de ser considerado una invasi\u00f3n a las competencias que le otorga la Constituci\u00f3n como autoridad.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00bfCu\u00e1l es la reducci\u00f3n de tiempos oficiales en radio y TV que aval\u00f3 la SCJN?<\/h2>\n\n\n\n<p>Fue el pasado 3 de abril de 2020 cuando el presidente AMLO firm\u00f3 un acuerdo para la devoluci\u00f3n de los tiempos oficiales a estaciones de radio y canales de televisi\u00f3n.<\/p>\n\n\n\n<p>El decreto firmado por <strong>AMLO <\/strong>redujo de 18 a 11 minutos diarios el tiempo que deben entregar las estaciones de televisi\u00f3n abierta.<\/p>\n\n\n\n<p>Los <strong>tiempos oficiales en las estaciones de radio <\/strong>se redujeron de 35 a 21 minutos.<\/p>\n\n\n\n<p>Lo anterior para que con ello se tenga por satisfecho el pago en especie de un impuesto a las concesiones, que existe desde 1968.<\/p>\n\n\n\n<p>Cabe destacar que los <strong>tiempos fiscales<\/strong> motivo de la controversia son distintos de los tiempos previstos en la Ley Federal de Telecomunicaciones y Radiodifusi\u00f3n (LFTR) de 2014.<\/p>\n\n\n\n<p>Al momento la LFTR contin\u00faa sin cambios y abarca media hora diaria de transmisi\u00f3n gratuita en todos los canales y estaciones.<\/p>\n\n\n\n<p>Seg\u00fan expuso el ministro<strong> Jorge Pardo<\/strong>, el decreto no afecta los 48 minutos totales que la Constituci\u00f3n reserva al INE para administrar durante los periodos electorales, y que suman los 30 minutos de la LFTR, m\u00e1s los 18 de tiempos fiscales.<\/p>\n\n\n\n<p>No obstante, en \u00e9pocas no electorales, los tiempos para el INE se reducen hasta un m\u00e1ximo de 12 por ciento de todos los tiempos del Estado, por lo que \u201cera permisible\u201d la medida adoptada por el AMLO, detall\u00f3 el ministro Jorge Pardo.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El pleno Suprema Corte de Justicia de la Naci\u00f3n (SCJN) valid\u00f3 el decreto de AMLOque reduce los tiempos oficiales en radio y televisi\u00f3n (TV).
